What Estate Planning Looks Like in Arizona

Arizona is one of the better states in the country for passing wealth to the next generation, and most clients we meet don't realize how far that advantage goes. Arizona has no state estate tax and no inheritance tax — the only estate tax exposure for almost every Goodyear family is at the federal level, and the federal exemption rose to $15 million per person ($30 million per married couple) on January 1, 2026 under the One Big Beautiful Bill Act. For most West Valley families, that means estate planning is no longer about avoiding tax — it's about avoiding probate, protecting beneficiaries, and coordinating the documents you already have. Arizona raised its small estate affidavit thresholds in September 2025 to $200,000 in personal property and $300,000 in real property. Estates above those limits — which describes most homes in Estrella, Verrado, PebbleCreek, and Litchfield Park — go through Maricopa County's formal probate process unless a properly funded revocable trust is in place.

How We Work With Goodyear and West Valley Families on Estate Plans

Most of the estate-planning conversations we have at our Goodyear office start with the same three documents: a will or trust drafted years ago in another state, beneficiary designations on a 401(k) and an IRA, and a deed to an Arizona home. Our job is to make sure those three pieces actually work together under Arizona law — including community-property rules that govern how retirement accounts pass to a surviving spouse. What is an estate plan and why?

When should I start estate planning?
We believe you should start estate planning as soon as you have dependents, significant assets, or anyone relying on your income. Major life events—such as marriage, children, divorce, retirement, or starting a business—are ideal triggers to create or refresh a plan. Beginning early lets you act calmly and thoughtfully rather than rushing during a crisis.
What documents are usually included?
A typical estate plan includes a will, possibly one or more trusts, a financial power of attorney, a health care directive, and updated beneficiary designations. Each plays a different role, from directing who receives your assets to naming who can act for you if you cannot act for yourself. We design these documents to work together so there are no gaps or conflicts.
Who needs a trust versus a will?
A will directs how assets in your name are distributed and who becomes guardian of minor children, but it usually goes through probate. A trust can help avoid probate, provide more control over when and how heirs receive funds, and offer additional privacy and protection in complex family or business situations. We help you consider whether a revocable living trust or other trust types make sense as part of a coordinated plan.
How often should I update my plan?
